Purpose and legal bases of data processing, pursuant to Art. 13 (1) c GDPR

The personal data are processed for the purpose of fulfilling contracts or implementing pre-contractual measures. This includes customer master data with contact persons as well as contact history, quotes, orders, invoices, project data, applicant data, further information relevant for the arrangement and further legal obligations of the controller.

The legal bases result from Art. 6 GDPR. Further essential legal bases result from the German Commercial Code (Handelsgesetzbuch), tax legislation, the Limited Liability Companies Act (GmbH Gesetz) and other legal requirements relevant for Alpensped GmbH. This also includes contractual provisions. Newsletters are processed on the basis of the consent of the data subjects. Applicant data are passed on to corporate customers on the basis of the consent of the data subjects.

The respective purposes result from legal requirements as well as from relevant industry-specific regulations. The personal data will be erased after the purpose has been achieved.

Information about the rights of data subjects

The data subject has the right to obtain from the controller confirmation as to whether their personal data are processed; if this is the case, they have the right to information about such personal data and to the information specified in Art. 15 GDPR.

The data subject has the right to request that the controller immediately rectify any incorrect personal data concerning them and, if necessary, complete any incomplete personal data (Art. 16 GDPR).

The data subject has the right to request that the controller immediately erase their personal data if one of the reasons specified in Art. 17 GDPR applies, e.g. if the data are no longer required for the purposes pursued (right to erasure).

The data subject has the right to request that the controller restrict the processing if one of the conditions specified in Art. 18 GDPR is met, e.g. if the data subject has objected to the processing for the duration of the controller’s investigation.

The data subject has the right to object at any time to the processing of their personal data for reasons arising from their particular situation. The controller will then no longer process the personal data unless they can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves to establish, exercise or defend legal claims (Art. 21 GDPR).

Rights of data subjects pursuant to Art. 13 (2) c GDPR

If you have given us your consent to process personal data for certain purposes (e.g. processing pictures of the data subject), the legality of such processing is on the basis of your consent.

Where given, consent can be withdrawn at any time. This also applies to the withdrawal of declarations of consent given to us prior to the GDPR coming into force, i.e. before 25 May 2018.

Please note that the withdrawal will only take effect in the future. Processing that took place before the withdrawal is not affected.

Right of appeal to a supervisory authority pursuant to Art. 13 (2) d GDPR

Without prejudice to any other administrative or judicial remedy, all data subjects have the right to appeal to a supervisory authority if the data subject believes that the processing of their personal data is in violation of the GDPR (Art. 77 GDPR). The data subject may exercise this right before a supervisory authority in the Member State that is their place of residence, work or the place of the suspected violation.

IP anonymization

On this website, we have activated the IP anonymization function. As a result, your IP address will be abbreviated by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. The full IP address will be transmitted to one of Google’s servers in the United States and abbreviated there only in exceptional cases. Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Demographic parameters provided by Google Analytics

This website uses the function “demographic parameters” provided by Google Analytics. It makes it possible to generate reports providing information on the age, gender and interests of website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data.”

Archiving period

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising programme of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

Within Google AdWords, we use “Conversion Tracking”. When you click on an ad placed by Google, a Conversion Tracking cookie is set. Cookies are small text files that the Internet browser stores on the user’s computer. These cookies expire after 30 days and are not for the personal identification of users.
